When a mistake may need specialist advice

Understand the distinction between a complaint and a potential legal claim.

A mistake, a poor outcome and professional negligence are not automatically the same thing. If something went wrong and caused a loss, an independent specialist can assess your circumstances.

Prepare for an initial conversation

  • Explain what the lawyer was instructed to do.
  • Identify the mistake you believe occurred and the relevant dates.
  • Describe the loss and keep evidence of how it arose.
  • Keep the client-care letter, advice and relevant court documents.

Ask about scope, costs and deadlines

Check that the adviser has relevant experience. Ask how the assessment is charged, what work it covers and what costs could arise if you continue. Do not assume any particular funding arrangement will be available.

A complaint may still be relevant

A service complaint and a potential negligence claim may overlap. A specialist can help you understand how available routes interact. Avoid accepting a settlement without understanding what it resolves.
